Zero Tolerance: Sensible Change in Policy

The zero tolerance policy is long overdue for an amendment, many cases that went forward to involved law enforcement was NOT necessary at all, hopefully this change in policy will benefit all the children, as well as adults. Bear in mind, children are still growing and learning, there is so much exposure to their young minds, we, as adults have a duty to "guidance" and "discipline" them, but not contribute to them having a "record", for mistakes made as a "child". Of course I well understand/realize some issues warrant law enforcement involvment, but each case should be investigated thoroughly and proper steps taken, in helping all concerned.

Punishment is warranted, but as the children they ARE....... with discipline, to include rehabilitative efforts to help them become productive members of society, far too many children are being locked away and throwing away the "key". So many "children" NEVER had a "chance", never "offered" a "chance to "change."

It disgusts me to read they say, "this child is UNFIT"...HOW DO "THEY" KNOW????
Tho in this case, this "child" should be punished, BUT as a child, the above article actually states they have given up on her, she is beyond rehabilitation or redemption. FAR too many of our nation's youth are just thrown away, with NO help, NO guidance, NO counseling, NO rehabilitative efforts, offered NO chances to even attempt to turn their lives around, a "chance" to become a "productive" member of society. Prosecutors are experts in the field of anatomy, psychology, physiology of the human brain and body??? Crime is NOT condoned here, but she is 14 yrs of age, clearly NOT an adult. Justice must be "tempered" with compassion and mercy. Until that happens, more and more "children" will be "destroyed" by the present day laws, prosecutors have been allowed entirely TOO much "power" in governing these cases. Juvenile law reform is "imperative", to help save our nation's youth!!!

This article brings out/repeats what we juvenile advocates have been saying for years, there have been many "studies" on this subject, but when will the officials listen and take action? Juvenile LAW REFORM is imperative to help save our nation's "youth" from doom and "deaths."
The report, 'From Time Out to Hard Time: Young Children in the Adult Criminal Justice System,' provides a comprehensive look at how the nation treats pre-adolescent children (primarily those age 12 and under) who commit serious crimes.


Children should be handled in the juvenile justice system, where they can obtain the rehabilitative services and programs necessary to help them become productive adults. Lawmakers must reconsider and reverse these punitive laws.

Crime is NOT to be condoned and punishment warranted if 100% guilty, but NOT to consider any fact of this young man's efforts of turning his life around was a gross INjustice. Prison will in fact strip him of all he ever accomplished so far, and learn of things no one should ever be exposed to. So what kind of man will he be, when he is finally released. There is cause here to be bitter and angry, for even tho he "tried"/made an effort to amend his ways, he still got kicked in the teeth(so to speak.)


Judge Downs wasn't moved. Although he did rule that Peterson's "local support network" and acceptance of responsibility for his crime were mitigating factors, he still sent the young man to prison for 44 months

"Of all the issues being considered by the Supreme Court this winter, none is more emotionally charged than life sentences for teenagers. The justices must decide whether sending minors to prison without any possibility of parole is a "cruel and unusual punishment" prohibited by the Eighth Amendment to the Constitution. It is a narrow point of law, but the purpose of America's penal system is in the dock."



I agree with this summation, all cases of children under the age of 18, should be dealt with in a "juvenile court of law", as the child they ARE. If a child is 100% guilty of a crime, indeed punishment is "warranted" But as a "child", NOT with ADULT sanctions. To include not only incarceration for a period of time, also with discipline, counseling, rehabilitative efforts to help them become "productive members of society". At the very least, OFFER them a "chance", if they do not try to change or conform in being productive, they will continue to face that sentencing. They should be evaluated periodically during their incarceration, for any improvements in their lives, and recommendations made accordingly by the governing facility. Far too many "children" are ware housed, with NO chance, NO hope, NO counseling, NO rehabilitative efforts, only to die off in prison, for "mistakes" made as a "child". Juvenile LAW REFORM is long overdue, to help save our nation's youth.

It's the easy political call. No one ever lost an election by being "tough on crime." As more states are learning, however, it's more important to be smart on crime. Lock up only the dangerous. Try to rehabilitate the others. Don't criminalize mental illness or addiction. Treat it. Help ex-offenders reenter society. Turn around a person's life, and you prevent a crime. Smarter. Cheaper. Safer.

Tho background circumstances are unknown in this case, what is the point in jailing this child, because he does not want to have "visitation" with his father.? He is 14, old enough to know who he wants to be/live with. Why "punish" this child with jail time? Is that going to make him a better person? Will jail time make him change his mind about his father? Will jail time help improve the overall situation? Could there not have been other alternative solutions to these circumstances? AND, once he is placed in juvenile detention, what will happen to him there? Will he be safe? Will he recieve the care and nurturing a young child needs in this situation? The judge sends him to "juvenile detention" center, just because he does not want to "visit" with his father! A "contempt of court" charge! What's MORE important? A contempt of court charge, or the emotional trauma this child is forced to endure??? It will only made this child more bitter, more rebellious, more non-compliment, so really nothing "positive" gets accomplished. This child should NOT be "forced" to stay with his father. Where is the "in the best interest of the child" concerns? Unfortunately, many children in the past have injured or killed their parent/s....this concern within itself, should be a "red flag" in the mind of that judge!!! No one can predict, the mindset of this child, if he is "forced" visitations with his father.

For those who forget that the incarcerated humans in this country are indeed just that - HUMAN - I would like you to think on this the next time you talk about “inmates, criminals, convicts, etc…”. These humans have families and those who love them despite whatever they did. Look around you and wonder, because this is who we are….......

We take care of your children and grandchildren in nursery schools, we give them shots in the doctor’s office, we are dental assistants, we are school teachers and Sunday school teachers, we stand behind you in the grocery store, we prepare your medicine in the drug store, we work in banks, we approve your loans, we service your insurance claims, we work for newspapers, TV stations and radio stations, we read your electric meters and water meters, we are your landlords, your neighbors, we take care of your elderly parents in nursing homes, we are doctors, nurses, lab technicians, X-ray technicians, we own beauty shops, flower shops, printing shops, we are welders, plumbers, tree trimmers, we work for the IRS, the State Dept., in the courthouse, schools, churches, drug stores and toy stores, we are legal secretaries, lawyers, police officers, firemen, paramedics, movie stars, producers, directors, musicians, senators, school board members, we are bus drivers, we prepare meals for your kids in school, we are city council members, bank tellers, we process your checking account, your saving account, we work at your Social Security office, your insurance company, we are accountants, we take care of your IRA, stocks, bonds, we sell your kids bikes, school supplies, clothes, shoes, eyeglasses, we repair your cars, we are real estate agents, car dealers, college professors, psychologists, administrative assistants, safety engineers and ranchers. We work at Ralphs, Albertsons, Trader Joe’s, Wal-Mart, K-Mart, Target, Macy’s, Nordstrom and Saks 5th Avenue. We sell Avon and Tupperware. We are not all “on welfare”, no matter what the government would like you to think.

Our children set next your child on the bus, in school, at church, they play at the park together, the sleep over at your house, they sell you Girl Scout cookies, they are in the Cub Scouts together, they go to college together, play sports together, go to the movies, the mall, theme parks, they swim together, they talk on the phone with your child, cut your lawn, rake your leaves, walk your dog, and do it with a smile on their face even when society sees them as the spawn of evil.

There are two million people in prison in America and twice that many on parole and probation. Add in mothers, fathers, children, sisters, brothers, aunts, uncles, grandparents, cousins, wives, husbands and friends and about sixteen million people are personally affected by the prison system in the United States.

We are tired of letting ourselves feel humiliated or embarrassed because our loved one is in prison. We did nothing wrong, and they are paying for their crime!

We are tired of fearing the loss of our jobs or evictions from our housing should anyone find out we have a loved one in prison.

We are tired of being made to feel inferior or unwelcome in churches, clubs, organizations or society in general simply because we refuse to abandon our loved ones.

We are ready to unite, to come out of hiding and openly support each other and our loved ones. It’s a new day, America and we’re here to prove it!

We are ready to speak out against the “they deserve what they get” attitude we hear you talk about in stores, theaters and restaurants, and on the internet.

We number in the millions, we are everywhere, every state, county, city and town. We may even live next door to you.

Sixteen million and counting.
We are everywhere.

Juvenile Lifers deserve second chance

Throwing away the "key" for these children is "a slow "death"/state sanctioned murder", indicating these children do not deserve redemption or any chances to prove they can "turn" their lives around and become "productive" citizens. IE: Many children were sentenced to life with NO chance of parole, and they did NOT murder anyone.


"It is impossible to know what any juvenile offender will grow up to become," their brief says. "But it is also impossible to conclude that any juvenile offender has no redeeming potential."

Best therapy this child can recieve is under the direction and supervision of his own mother and to recieve mandated counseling, the "emotional nurturing" for this child, no one can do it better than his own mother....Some one give this child a "chance" to grow up to become a productive member of society.

I am grateful to have gotten a second chance -- and I believe our society should make a sustained investment in offering second chances to our youth........

Senator Simpson: Give kids a chance

Many children are in prison, for being in the wrong place at the wrong time, so easily "influenced" by "others", and did NOT murder anyone, but was present at the time "others" actually did the crime, but got long, hard, cold sentencing, for "that" mistake!

What about the 8 and 11 yr old children that alledgedly committed murder? Wonder what the U. S. Supreme Court think about those children, so young, yet many "out there" feel "they" also should be sent to "life" with "no" chance of parole. Is this NOT barbaric and inhumane. NO compassion, NO mercy, a sentence to a "slow" death, is STILL the "death penalty", STILL state sanctioned "murder" of those children.!!



The U.S. Supreme Court heard oral arguments Monday about whether it is cruel and unusual punishment to sentence certain juvenile offenders to life in prison without the possibility of parole.......

"Addiction kills. It breaks hearts, tears lives apart and kills people. By the droves. Every day. What if we stopped denying it?

Sis Wenger, President and CEO of the National Association for Children of Alcoholics (www.nacoa.org), says that "people are willing to support children all over the world who are hungry, needing surgery so they can smile again or in need of food, shelter or medicine. But they can't see the one in four children who suffer in silence, fear and confusion right here in our own communities......."


A growing very serious problem, not only in schools, but everywhere in a "child's" enviornment. Many times, these children ARE in danger of injuries and/or death.

What about this child?

On Nov 9th, U. S. Supreme Court is to rule on 2 Fl cases, referencing Juveniles sentenced to life with no chance of parole for non-homicial cases. Krista McDaniel is one of many children (under 18) who got caught up with the wrong people, at the wrong time, from dysfunctional families, Krista a baby born to a teen mother of only 15 herself, no father in her life, wounded up with the wrong people, children are so easily "influenced"by others. Krista, like other incarcerated children did not do a murder, but yet, got a long, harsh sentencing, with NO chances, NO redemption, NO guidance, NO counseling, NO educational efforts, NO nothing to look forward to, to better themselves ONCE they are released.
Children are in a "growing process", the anatomy, physiology and phychology of the human brain is constantly changing, growing into "adulthood". Chances to "redeem" themselves, are never offered by officials, never given a chance of evaluations periodically during their incarcerations. What "incentives" do they have?
The simply offer of a "chance" is long overdue for many of these children. Many of them have "grown up" behind those cell walls, but try hard to better themselves in hopes one day, the "chance" will come along their way. It IS cruel and inhumane they are NOT "offered" at the very least, a "chance" to "prove themselves" to society, they are NOT a bad person.

For the sake and life of Krista's and many other children in America, It is my most sincere wish, the courts will deeply consider the developing stages of a growing child, and consider giving them that ONE chance, that was NEVER OFFERED!

Throwing away the "key"/Juveniles deserve a "chance"



The American Bar Association, the American Medical Association, and the American Psychological Association support giving juveniles a chance at parole.

So does former Sen. Alan Simpson, R-Wyo., whose own life story is persuasive. As a youth, Simpson burned down an abandoned federal building and fought with a police officer. He said most juveniles convicted of terrible crimes may well remain locked up, but they at least deserve the possibility of a second chance.

Supreme Court Will Scrutinize Life Sentences for Juveniles

In majority opinion in the 2005 case, Justice Anthony Kennedy wrote, "The reality that juveniles still struggle to define their identity means it is less supportable to conclude that even a heinous crime committed by a juvenile is evidence of irretrievably depraved character. . . It would be misguided to equate the failings of a minor with those of an adult, for a greater possibility exists that a minor's character deficiencies will be reformed."


This child sentenced to life + 4 yrs, with NO chance of parole, for killing a pimp. Background history of this child warranted consideration, but there was NONE. "Children" DO change, ARE amendable to treatment, rehabilitative efforts, guidance and counseling, to become a "productive member" of society. This cold, harsh sentencing of this child, is barbaric and "inhumane". Even MORE reason, to never be silent about these "atrocities" against our nation's youth. Please, get involved in these issues, YOU CAN make a difference!

The Centers for Disease Control has found that juveniles who are prosecuted and sentenced as adults are 34 percent more likely to be re-arrested than those who stay in the juvenile system. They become more violent and better criminals when they have been in the adult system. Many of them have been victims of abuse and neglect in their own homes. They are two to three times more likely than the general population to have a mental disorder. They lack the maturity and judgment to appreciate the seriousness of their acts, and have poor self-control..........

Juvenile Law Reform/long overdue/Children under Seige

Our nation's children(under 18) are under seige. They are being held at zero tolerance levels in schools, infractions of the smallest mistakes, sometimes leads them facing officials, many under arrest, waivering their constitutional and miranda rights, many are questioned without an attorney and investigations are NOT videotaped from the very beginning of questioning these children. Many young children have been arrested for an alleged crime, have been tried, convicted and sentenced as an adult, even at the very tender ages of 12, 13 yrs of age. The development of a person's brain has not completely developed, matured, until in their early twenties.

This is not a call of guilt or innocence, but the fact that children of this nation are being tried as an adult, they clearly are not. Children under 18, by law, are not allowed to do many things, IE, get a tattoo, buy a car, cigarettes, watch x rated movies, get a job, sign a contract, etc, ALL of the amenities of an ADULT, yet if one gets into some trouble or commits an alleged crime, the officials seems to automatically waive their case up to adult court immediately. Some state laws dictates the case to go to adult court first, then the defense attorney has to petition the court to have the case remanded back to juvenile courts. Many children have been given long, harsh sentences, many with life and/or life without any possible chance of parole, due to the fact that state laws are written to treat children with adult sanctions, for the same crime, as if an adult committed the crime.

Laws must and need to be changed, reformed, governing "children". State laws statures, exception of about two states, dictate the definition of "child"/"juvenile", which is one who is under 18 yrs of age. Far too many children have met their doom in prison "forever" without any chance of parole, for a mistake allegedly made when ONLY a child. No chances, NO redemptions, NO counseling, NO rehabilitive efforts ever offered these children, leaving them to die off in prison.

This is indeed, a direct violation of their constitutional amendments of "cruel and inhumane" treatment. If, in fact, punishment is due, punishment should be administered in a juvenile detention facility, along with compassion, mercy, and a chance for these children to become productive members of society. So many children never had a chance, and are dead, died behind bars, just awaiting for their trial date.

Has America become so cold, so callous, so unforgiving, so uncaring, so unwilling, as not to, at the very least reinvestigate the existing laws governing these children.

I was released from prison in 2004 after my third parole hearing. I received bachelor's and master's degrees from University of Detroit Mercy. Blood dripping to the floor, from her small body, switches cutting the skin deep with every whipping lash, she was only around 3 or 4 yrs of age. Was tied hands and feet, naked, hanging from the ceiling with a rope, beaten unmercifully from head to toes, because she let the "chickens" out of their coop. Then the rope above her head was cut, her falling to the floor like a side of beef, salt rubbed into her every wound. Her screams echoing/deafening thru the years.....One of many horrific, barbaric beatings this child had to endure, for minor mistakes made as a small, immature child. Trying to survive in an adult world. Where was the compassion, mercy, caring and understanding, most of all where was any love? hugs?

So many of our nation's youth are suffered terribly behind "closed doors", the world will never know, will never see, so unfortunately until the death of so many children abused and murdered, so innocently born into such an evil world.

I was that child of so long ago, and still trying to survive in an adult world.

NO CHILD should EVER have to experience such a miscarriage of "justice" ever again. One of the many things wrong with this so called system, is that "immunity" is in place for these corrupt so called judges, knowingly, willingly and deliberately DENIED JUSTICE to those children. Yet, do you really think justice will be served in this case??? I really doubt the punishment if given out at all, would ever fit the horrible crimes they did against those children. "Beaurocracy" at it's finest.


While the focus of the upstate Pennsylvania cash-for-kids scandal rightly has been on two rogue judges, a legislative oversight panel last week began a review that should make other stakeholders in juvenile-justice and political circles squirm.



Jordan Thomas was still in the hospital after having his lower legs amputated when he learned that many children can't afford prosthetic limbs.

He was only 15 when he lost his lower legs in a boating accident. But Jordan, now 20 and a junior at the College of Charleston, considers himself fortunate. He's been able to get the four sets of prosthetic legs he's needed over the past several years as his injured limbs grew and changed. His legs cost $24,000 a pair, which is less expensive than some because his injuries were below his knees.

It was three years ago that 15-year-old Eric Hainstock entered Weston High School with a 22-caliber pistol and a 20-gauge shotgun. Within a few short minutes, Principal John Klang confronted Hainstock, trying to protect his school's students and staff. After a brief struggle, Klang was shot three times. He died later that day. Debate continues on exactly what Hainstock intended to do - get the school's attention for the help he needed, or execute a fatalistic death wish for himself and his school.

I am totally appauled at that statement!!!!
