"Take Action: Currently in California, children—no matter how young— can waive their Miranda rights. When law enforcement conducts a custodial interrogation, they are required to recite basic constitutional rights to the individual, known as Miranda rights, and secure a waiver of those rights before proceeding. The waiver must be voluntarily, knowingly, and intelligently made. Miranda waivers by juveniles present distinct issues. Recent advances in cognitive science research have shown that the capacity of youth to grasp legal rights is less than that of an adult. This is especially true for very young, developmentally disabled, or cognitively delayed children, and for those with mental health problems."

"I would have been a "nobody" without you, over the years, I was lost, abandoned by officials, society & many of my own family, my own dad disowned me when he found out about my baby, I was only 14, pregnant, had my baby at age 15, then caught up with wrong evil adults at just turning 16,landed me in prison for 30 yrs with NO chance of parole. Today I am in my 14th yr of that 30 yrs, I turn 30 yrsof age in Aug, growing up in prison, my baby is now 14 yrs of age. STILL in prison due to the "no parole status" and the SC law "the hand of one is the hand of ALL." I have my up and down days, but overall, I am so fortunate to have you in my life, for many here, have absolutely NO ONE, with no visits, no mail, no canteen funds, no nothing, feeling so hopeless with severe/chronic depression.

 I will be forever thankful you took me under your wing, so I could learn how to fly. I cherish these moments you have shared, as part of your life, Thanks to YOU, I AM SOMEBODY.....

"The larger project is to ensure that children’s lives—at school, at home, on the street—are not ended before they can begin by criminalizing them into oblivion."
To help save our nation's children, parents and community leaders must be involved, children need to know/be aware of their "legal rights." They need/must know/be aware of their "miranda rights." Parents are strongly urged to get educated themselves and TEACH their children. Children "learn" from their surroundings & see/do what other people do, they desperately need GUIDANCE, to stay on the good path of life, IMO

"The Chicago-based Juvenile Justice Initiative supports a proposal in Illinois to require that juveniles in police custody have a lawyer with them during questioning.  Police must make a reasonable attempt to contact a child's parents under existing law."
Children in ALL states have the right & should have a lawyer present at any questioning whatsoever.  Children do not/ are not aware of any legal jarjon or procedures, they too, have legal rights under our U. S. constitution.

Krista’s patience is thin, her hopes are slipping away, but she will never give up for she states  “JUSTICE IS MINE”

In all my reading and extensive research of this case against Krista McDaniel for the past 14 years….It is NOT amazing at all, but indeed “appauling”, that Krista was assigned to 2 lawyers.  ONE-1ST assigned lawyer was involved in some type of drug crime, and was disbarred.  Krista lingered in the Charleston, SC jail for approx. 9 months without “legal representation”  Authorities kept Krista in this jail until she turned 18 yrs of age, she then was ordered before a judge, for sentencing to 30 yrs with NO chance of parole(Nov 2004) Crime she was accused of(Nov 2002)Just 3 months after she turned age 16.       2nd assigned lawyer did nothing for Krista’s defense, only to approach her again, with a plea deal. What choice did she have really??    She was facing the death penalty or 30 yrs w/no chance of parole.   To my knowledge, neither lawyer ever questioned the fact that Krista was interrogated  x 2   without the presence of an attorney. Never mentioned anywhere, at any time. 

We both continue to search for “justice”, tho thousands of letters have already fell upon the deaf, dumb and blind in reference to the “atrocities” bestowed upon this child.

Below are comments from one advocate who has fought for years for a child who has experienced the glutches of a grossly INJUSTICE SYSTEM..

"We're still fighting this every day. I'm still fighting every day for someone who was affected by this. Not only sentenced once to LWOP, but REsentenced to LWOP... in spite of Miller, in spite of mountains of scientific evidence, in spite of Hillary's denials, in spite of Dilulio's recantation, in spite of the CP5 exonerations, in spite of it all being debunked, in spite of it being nothing more than bullshit, in spite of being a model inmate, the fall out from this explosion is still pouring on us.

A barely 15 y.o. assaulted by a mentally ill man in a rage, charged with murder, assigned a shyster lawyer, interrogated alone, tried as an adult, no investigation, no witnesses, no mention of exculpatory evidence, no criminal record, no violent past, still fighting the fury of the "child predator" lie. The lie that subjected an 8th grader to adult charges, adult prison and a living death sentence.

Maybe Hillary Clinton should volunteer to write a letter to the fearful judge who is more concerned about his election and reputation than to do the right thing and give a convicted "child predator" a sentence with parole eligibility. Maybe she should explain to the scared judge that it was a mistake, there is no such thing and the language was wrong. Maybe we should have put her on the witness list at the Miller resentencing.

Hillary doesn't give a hoot about any kid living life out in a cage. No, she cares about being president. She's not sharing any of the load, her or the "comeback kid" Bill Clinton.
After Brett heard he's never getting out of prison for the second time, he said to me, this is a setback before my comeback. Hopefully, due to good people who really do give a hoot, who are dedicated to doing what's right, Harvard educated lawyers who aren't bought and paid for."

Excellent, "informative" article, so many children still lanquishing in prison, for mistakes made as a child, this article talks about "how" many of these children got to where they are today, IMO
Lack of compassion, mercy, recognizing that children ARE children and NOT adults, are imperative to help save them from "doom & deaths"

“First, children have a ‘lack of maturity and an underdeveloped sense of responsibility,’ leading to recklessness, impulsivity, and heedless risk-taking. Second, children ‘are more vulnerable to negative influences and outside pressures,’ including from their family and peers; they have limited ‘control over their own environment’ and lack the ability to extricate themselves from horrific, crime-producing settings. And third, a child’s character is not as ‘well formed’ as an adult’s; his traits are ‘less fixed’ and his actions less likely to be ‘evidence of irretrievable depravity.’” 567 U. S., at ___ (slip op., at 8) (quoting Roper, supra, at 569–570; alterations, citations, and some internal quotation marks omitted)."

Case presented to the U. S. supreme court was for those children sentenced to life with NO chance of parole, it did NOT refer to or address those perimeters, for children who have recieved long, harsh sentences with NO parole. Another entity to be resolved, while these children also lanquish in prison, some who did NOT do/participate in a crime, but unfortunately some of them were with the one/s who did do the crime. The governing guidelines set forth in above ruling, certainly should be "considered" for ALL juveniles, regardless of their sentence, with a NO parole status, IMO, is discrimination and a violation of the 8th amendment as to "cruel and unusal punishment". So when will this group of imprisoned children recieve justice, they so deserve??

"Writing for the majority, Justice Anthony M. Kennedy conceded that not every juvenile who was convicted of murder should be given parole, but every one should have the opportunity for a hearing."

IMO, "ALL" children must be "allowed" a "chance of parole", far too many children recieved very long, harsh sentencing with NO chance of parole, but latest ruling(case) from the U. S. supreme court only referred to those children who recieved life with no chance of parole, is this not "discrimination" for the other children imprisoned WITHOUT PAROLE? Another issue to be dealth with, also NOT having a chance of parole, IMO, is cruel, violates the 8th amendment. We must continue to make our voices heard for those who still linger in prison, since they were a "child." People DO change, they should at least have a "chance" to prove to officials and society, they are NOT that immature/naive "child" anymore. Present state law legislation must be considered/amended to at the very least allow "PAROLE STATUS".

Its parts will work independently and never realize their common goal because a champion to lead them to do something uncommon is missing."
Children DO deserve a "chance", to become a productive member of society, officials must change/amend current state laws, that indicate as well, compassion and mercy for our nation's children, otherwise they are doomed for life, IMO
